New Taipei City, Shulin – June 6, 2017 - EVERLIGHT Electronics Co., Ltd. on April 25, 2017 has filed its complaints with Tokyo District Court against Nichia Corporation, Citizen Electronics Co., Ltd. and Daiko Electronics Co., Ltd. for infringement of EVERLIGHT’s COB (chip on board) patents. EVERLIGHT also requested an injunction on the defendants from any manufacturing, selling, importing or exporting any infringing products and a destruction of all infringing products and that the defendants should bear EVERLIGHT’s damages. Nichia on its June 2 press release indicated that it has not received the Complaint. As the case has been docketed with the Tokyo District Court, all proceedings will be in accordance with the Court’s rules and schedule. EVERLIGHT suggests Nichia to contact with Tokyo District Court for details of service.
In response to Nichia June 6 press release regarding preliminary injunction in Germany, the European Patent No. 0936682 is still involved in an invalidation proceeding before German Federal Patent Court. As the corresponding U.S. or Taiwanese patents of the EP‘682 patent have been declared invalid, EVERLIGHT believes the EP‘682 patent should be invalid as well.
